Cape ClashTerms of Service

Version: 5 November 2026 · Last updated: 5 November 2026

These Terms cover Cape Clash, its online features and related in-game content. They explain what you can expect from us, the rules for playing, and how purchases and problems are handled.

Who provides Cape Clash?

In these Terms, “we”, “us” and “LoJ Gamez” mean this trader. “You” means the person using Cape Clash.

1. Agreement and age

Please read these Terms before using Cape Clash. By accepting them, or using the game after a reasonable opportunity to read them where this forms a valid agreement under your local law, you agree to follow them. If you do not agree, do not use the game. This does not remove any right to a refund or another remedy.

Cape Clash is intended for players aged 13 or older. You must also meet any higher minimum age that applies where you live. If you are below the age at which you can enter this agreement yourself, a parent or legal guardian must review and agree to it and permit your use where local law allows. A parent or guardian should supervise a minor’s online activity and authorize purchases. An age rating alone does not establish contractual capacity or consent to data processing.

2. Your licence and our work

We give you a limited, personal, non-exclusive licence to install and play Cape Clash on compatible devices you own or control, subject to these Terms and applicable app-store rules. The game is licensed, not sold to you. This licence continues unless you or we end it in accordance with these Terms.

Except for content belonging to players or other licensors, we own or license the game’s code, characters, artwork, story, animations, music, voices, sound effects, names and branding. You may not sell the game, distribute modified copies, extract and redistribute its assets, or use our protected assets to train an AI or machine-learning model without permission. Restrictions apply only to the extent allowed by law; they do not override rights under applicable open-source, Creative Commons or other third-party licences.

You may share ordinary gameplay screenshots and recordings, livestream your play, and monetize those videos through the usual video-platform features. Keep them lawful, do not imply that we endorse you, and do not publish extracted asset collections or unreleased material obtained without permission. This permission covers only rights we can grant; separately licensed music or other third-party material may have its own conditions. Credits and applicable third-party licence notices remain in the game and on the credits notice.

3. Accounts and progress

Some features work without a registered account; online features may use a guest or registered account. Keep your sign-in details secure, use accurate information where required, and contact us if you suspect unauthorized access. Do not buy, sell, rent or transfer accounts or knowingly let someone use your account to break these rules.

Local progress depends on the data held on your device. Removing the app, clearing its data, losing a device or resetting it can remove that progress. Use the game’s available account and backup features if you want to protect it, and check which progress they cover. We will use reasonable care in operating saves and restoring recoverable data, but cannot promise recovery of every lost local save.

You can stop playing at any time. The account deletion page explains how to delete an online account or request help. Account deletion, removing the app and requesting a refund are different actions; one does not automatically perform the others. Purchases and personal data are handled as explained in the applicable purchase terms and Privacy Policy.

4. Fair play and safety

Play fairly and treat other people with respect. You must not:

These rules do not prohibit ordinary accessibility tools or activity that applicable law expressly permits. Report a security issue privately to our support email; do not access other players’ information or disrupt their play to demonstrate it. Use REPORT and BLOCK where available, or contact us about unsafe content or conduct.

5. Chat and player content

You remain responsible for your display name, chat messages and other content you submit. You keep any ownership rights you have in that content. You give us a non-exclusive, royalty-free permission to store, transmit, display, format and moderate it only as reasonably necessary to provide the relevant feature, handle reports and comply with law. This is not permission to sell your messages or train an AI model on them.

This permission lasts while the content is reasonably needed for those purposes, including any lawful retention described in the Privacy Policy. It does not give us rights over content you do not own. Other players may see or copy messages they can access, so do not post confidential information.

We can remove or restrict content that breaches these Terms or the law. Moderation and account restrictions are covered in section 11. If you believe content infringes your rights, send us enough information to identify it and explain your claim.

6. Purchases and virtual items

Cape Clash is free to play. Optional paid offers may vary by platform and region. Before confirming a purchase, check the store’s checkout for its price, currency, applicable taxes, duration and included benefits. Your payment agreement and the identity of the seller or payment provider are shown by the store. We do not receive your full payment-card or bank details.

PREMIUM is prepaid access for the period shown at checkout. The current one-month and three-month offers do not renew automatically. Buying additional time adds the period stated in that offer. PREMIUM provides the benefits described in the game, including no rewarded-video viewing requirement, instant eligible video rewards, and the stated daily chests while the entitlement is active. Daily rewards must be claimed as described in the game.

A season pass is a separate product, if and when offered. It is not included in PREMIUM and does not include PREMIUM. Its offer must identify the season, benefits and end date. A pass for one season does not automatically carry over to another. No paid season pass is offered during the current Beta Season.

Heroes, coins, chests, cosmetics and other virtual items are rights to use game content, not money, deposits or investments. They cannot be cashed out or sold outside features we expressly authorize. Random reward contents and their odds are described in the game. Calling an item virtual, earned or used does not remove any statutory remedy relating to a paid purchase.

Use only the official purchase flow. You must have authority to use the payment method. Refunded, reversed or fraudulent purchases may have the corresponding entitlement removed; we will not remove unrelated legitimate purchases merely because you raised a genuine complaint or exercised a legal right.

7. Purchase problems and refunds

If a purchase does not arrive, does not work as described, was unauthorized, or you believe you are entitled to cancel it, contact the store or email us. Include the platform, purchase date, order reference and a description of the problem. Never send us a password, full card number or security code.

Google Play purchases can be addressed through Google Play’s refund process. For Apple-billed purchases, where offered, see Apple’s refund process. Store procedures can help process a refund; they do not limit our responsibilities or your rights under applicable law. You may contact us directly about those rights.

We do not promise a discretionary cash refund for every change of mind, nor cash redemption of ordinary earned items. We will provide refunds or other remedies when required by law, by the applicable purchase agreement, or by a refund decision we make. A refund is normally returned through the original payment channel, subject to the applicable legal requirements.

8. Regional consumer rights

The following explains some regional protections. It is not an exhaustive list, and protections in other countries also remain in force.

European Economic Area and United Kingdom

Applicable consumer law may give you rights to digital content and services that match their description, work as required, and receive necessary updates, including security updates. Depending on the problem and local law, remedies may include bringing the content or service into conformity, a price reduction, ending the contract or a refund.

You may also have a 14-day right to withdraw from a qualifying distance purchase. The rules depend on the product and local law. For digital content supplied without a physical medium, losing that right generally requires your express consent to immediate supply, acknowledgment that this means losing the withdrawal right, and the required confirmation. Ongoing digital services can have different rules, including proportionate charges where legally permitted. Merely accepting these Terms or using the game is not a blanket waiver. Where a withdrawal right applies, contact us or the store within the applicable period with a clear statement that you wish to withdraw; no special wording is required. Any mandatory online withdrawal function must also remain available where required.

Australia

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure, you are entitled to the remedies that law provides, including cancellation and a refund where applicable. For other failures, you may be entitled to repair, replacement or another remedy within a reasonable time. You may also be entitled to compensation for reasonably foreseeable loss or damage. These rights apply to digital games as well as physical products.

Other locations

Mandatory local rights concerning digital products, cancellation, children, contract fairness and remedies apply even if they are not named here. Nothing in these Terms makes a mandatory legal right depend on an app store granting a discretionary refund.

9. Ads and privacy

The game may offer optional rewarded ads. Ad availability and rewards are described in the game; a particular ad is not guaranteed to be available. Third-party advertisers are responsible for their own offers, but this does not remove responsibilities imposed on us by law.

The Privacy Policy explains personal-data handling and available choices. Agreement to these Terms is not consent to personalized advertising, tracking or another use of personal data that legally requires separate consent. Any such choice must be obtained separately. Report an inappropriate or broken ad using the in-game option or our support email.

10. Updates and service changes

We may update Cape Clash to fix faults, maintain security or compatibility, improve accessibility, balance gameplay, prevent abuse, meet legal requirements or add content. We will use reasonable care and provide information about material changes. Install necessary updates; if choosing not to install one causes a problem, your rights depend on whether we properly supplied and explained it and on applicable law.

Events have the dates and conditions shown in the game. Online play requires a working connection and supported software. Maintenance, network problems or incidents can interrupt availability. We cannot promise uninterrupted service, but will take reasonable steps to address problems within our control. Internet and mobile-data charges are your responsibility.

We will not use a general change right to take away a paid entitlement arbitrarily. If a material change, withdrawal of support or service closure adversely affects paid content or access, we will provide reasonable advance notice where possible and any continuation, cancellation, refund or other remedy required by law. Urgent security or legal action may require shorter notice. Describing a version as beta does not remove consumer rights or authorize an undisclosed reset.

11. Account restrictions and ending use

We may correct an invalid result, remove offending content, limit a feature, temporarily suspend an account or end access where reasonably necessary to address a material breach, cheating, fraud, serious safety risk or legal requirement. We will consider the seriousness, evidence and whether a less restrictive measure would resolve the issue.

Where appropriate, we will give a warning and opportunity to fix the problem. We may act immediately for serious abuse, security risks or legal reasons. We will explain a restriction and how to seek review unless doing so would compromise safety, an investigation or a legal obligation. Email us if you believe a decision is wrong.

Restrictions do not automatically forfeit every paid benefit. Any effect on purchases must be proportionate and comply with applicable law, including required refunds or remedies. You can end your use at any time and request account deletion. Terms that are reasonably intended to continue, such as intellectual-property protections and resolving existing purchase disputes, continue as far as lawful.

12. Responsibility for losses

We are responsible for losses caused by our breach of these Terms or failure to use reasonable care and skill to the extent required by applicable law. Subject to that law, we are not responsible for losses that were not reasonably foreseeable when the agreement was made, or for business losses arising from your use of a game provided for personal entertainment.

We are not responsible for a failure caused solely by circumstances outside our reasonable control if we took the steps that applicable law and reasonable care require. This does not excuse a failure to provide a required refund or other remedy.

Nothing excludes or limits liability for fraud, fraudulent misrepresentation, intentional misconduct, gross negligence, death or personal injury caused by negligence, breach of non-excludable consumer guarantees, or any other liability that the law does not allow us to exclude or limit. We do not require you to indemnify us for our own wrongdoing.

13. App stores and third parties

Google Play, Apple and other service providers have their own terms for their accounts, billing and services. Use an authorized copy of Cape Clash and follow the applicable store’s usage rules. These Terms do not make a store responsible for our obligations or us responsible for matters controlled solely by that provider, except as required by law.

For copies obtained through Apple’s App Store, Apple’s Standard End User License Agreement applies unless a valid custom licence agreement is supplied through App Store Connect for your territory. These Terms supplement that licence for related game services only to the extent consistent with it and mandatory law. Nothing here announces that a particular platform, payment method or future feature is already available.

14. Complaints and disputes

Please contact us if something has gone wrong so we can try to put it right. You do not have to complete an informal process before exercising a legal remedy or meeting a legal deadline.

Subject to mandatory law, these Terms are governed by the laws of Kentucky, United States. If you are a consumer elsewhere, this choice does not deprive you of mandatory protections under the law that would otherwise apply, including protections in your country of habitual residence.

You may bring a claim in any court that applicable law allows, including your local consumer court where permitted. These Terms do not require arbitration, waive class or collective rights where protected, or require a consumer to litigate exclusively in Kentucky. You can also contact a competent consumer authority or dispute-resolution body. We do not commit to a particular voluntary alternative-dispute scheme unless we separately agree or the law requires it.

15. Changes to these Terms

We may revise these Terms for the legitimate reasons described in section 10, to reflect changes in the game or to clarify them. We will publish a dated version here. For material changes, we will give reasonable advance notice through an appropriate in-game or direct notice where practicable and obtain renewed agreement where required.

Changes do not apply retroactively to an existing dispute or take away accrued rights. If you do not agree to a material change, you may stop using the affected service and retain any cancellation or refund rights the law gives you. We cannot treat silence or continued use as acceptance where the law requires something more. Privacy changes and consent choices are handled separately.

16. Contact and other provisions

Email lojgamez@gmail.com, or write to Jacob D White, trading as LoJ Gamez, at the address above. Tell us whether you need game support, a purchase remedy, moderation review or a legal/privacy response so we can route your message properly.

If a provision cannot be enforced, it will apply only to the extent lawful or be severed where appropriate; the rest of the agreement continues if it can fairly do so. A delay in enforcing a right does not by itself waive it. Any transfer of our business or this agreement must not reduce your existing rights; we will provide notice and any right to cancel that the law requires.

These Terms and the specific offer you accept govern the game services described here. They do not override binding pre-contract information, a more favorable express commitment we make to you, an applicable third-party licence, or mandatory law. The Privacy Policy explains data handling rather than granting additional rights over your information. If a legally required translation differs, the interpretation required by applicable consumer law prevails.
